Phonedeck integrates mobile calls with Salesforce and lets you manage your sales workflow in the browser or on smartphone. The CTI solution allows to work with mobile calls under the real mobile number and benefit from substantial cost and time savings.
The following Terms of Service ("Terms") govern the access to and the use of the computer smartphone integration (CSI) services provided by Phonedeck GmbH ("Phonedeck") to you, the users of its services. These services will be referred to as the "Phonedeck CSI Services". Phonedeck will not accept your terms, which deviate from these Terms, unless explicitly agreed upon in writing.
Phonedeck reserves the right to modify its Terms at any time, particularly in order to implement legal requirements or functional changes. Phonedeck will notify you about the changes. By accepting these changes, you agree to be bound by the revised Terms.

2. CSI Services offered by Phonedeck
Phonedeck provides the possibility to access telephony features of your smartphone directly from your computer via an account set up by you on the software as a service platform www.salesforce.com (“Salesforce”). This remote management of your mobile telephone enables you to use it via the computer. Phonedeck CSI utilizes a standardized adapter for 'Computer Telephony Integration' (CTI) on Salesforce called 'Open CTI'. This integration makes it directly in Salesforce possible for you to (1) establish calls on a mobile phone by clicking on a phone number, (2) get the number of an incoming call displayed and look up additional information by a database query as well as (3) log in- and outbound calls as tasks in the Salesforce database to track interactions with your customers via mobile phone. Phonedeck constantly synchronizes and temporarily stores the data concerning your communication via telephone (the "Communication Data"). The Communication Data include the call data (for instance incoming, outgoing, missed calls, duration of the calls) and the hardware model of your mobile phone. The synchronization takes place by the exchange of data between your mobile phone, the Phonedeck web service server and your account on Salesforce (the “Salesforce Account”). The temporary data will be deleted within 24 hours.
With its mobile apps for both the Android and the iOS platform Phonedeck provides the possibility to access and modify data from the user's database in Salesforce as well as to store it for offline-usage on the smartphone. The data is obtained via the officially documented application programming interface (API) of Salesforce (the "Salesforce API").
As part of the Phonedeck CSI Services, Phonedeck may provide you with certain communications such as service announcements and administrative messages. These communications are part of the Phonedeck CSI Services and you may not opt out from receiving them.
3. Use of the Phonedeck CSI Services
Prerequisites for using the Phonedeck CSI Services are an active Salesforce Account and (1.) the installation of a Managed Package from the Salesforce AppExchange marketplace (the "AppExchange") into your Salesforce Account in combination with the purchase of a license which gives you access to the Phonedeck CSI Services as well as (2.) the installation of the Phonedeck CSI application (the "Phonedeck CSI App") on your mobile telephone. In order to use the remote control features described in section 2.1 users of smartphone platforms other than Android need to also install a Bluetooth app (3.) on a computer which then needs to be paired with the smartphone device.
In order to install the Managed Package from the AppExchange you need to click on the button “Get it now” and log into your Salesforce Account. All Salesforce Account types listed in the AppExchange listing of Phonedeck CSI are capable to run the service. The purchase of a license is further described in section 4 below.

Only natural persons of full age and of unlimited legal capacity, legal entities and partnerships are allowed to register.
To match your mobile phone with your Salesforce account and to access data from from your account inside the app you need to enter your user login details inside the Phonedeck CSI App for Android or iOS. To enable the remote features for platforms other than Android you will also have to enter your user login details inside the Bluetooth application. The login mask is provided and the data is processed by Salesforce. Phonedeck only saves your user ID for identification with the webservice in anonymous form.
You may delete the Phonedeck CSI App on your mobile telephone and the Phonedeck Bluetooth application on your computer at any time. No communication data is permanently stored on the Phonedeck servers.
4. Subscription and Payment
Phonedeck CSI is a paid service. You can get access to our Phonedeck CSI Services by purchasing licenses via the AppExchange on a monthly or annual subscription base (the “CSI License”). The purchase price for the CSI License offered by Phonedeck is indicated on the AppExchange listing. You can purchase the CSI License by accepting Phonedeck's Terms and clicking on the button “Confirm and Install!”. The details of your order will be displayed and you can correct any possible errors. By continuing the purchase you submit your order finally and bindingly. You can review the text of the contract on the AppExchange under “My Account”. The subscription is paid per user and renewed on a monthly or annual basis. The subscription price for the first month or year is due and payable immediately after you begin to use the Phonedeck CSI Services and thereafter with every automatic renewal after one month or year. There is no minimum term for the subscription, thus you may cancel the subscription at any time on the AppExchange under “My Account” with immediate effect. However you will receive no refund for the already paid remaining days of the monthly or annual period.
CSI Licenses can be paid only by credit card. The recurring payment is processed by Stripe Inc, 3180 18th St, San Francisco, CA 94110. The customers’ sensitive cardholder data (credit card number, security code) is not passed to Phonedeck.
You can signup for a free trial of a certain amount of days that is defined in the AppExchange listing.
The Phonedeck CSI Service can be discounted on the basis of Stripe coupon codes.
You may offset claims arising from your contract only against undisputed or legally determined claims.
5. Right of Revocation

If you are a customer, you may revoke your contractual statement in text form (e.g. letter, fax, email) within 14 days without stating any reasons. The revocation period begins upon receipt of these instructions in text form, however not before conclusion of the contract and also not before we have performed our information duties according to article 246 section 2 in conjunction with section 1, subsections 1 and 2 of the Introductory Act to the German Civil Code (EGBGB) and our duties under section 312 g, subsection 1, first sentence of the German Civil Code (BGB) in conjunction with article 246 section 3 of the EGBGB. To meet the revocation deadline it is sufficient to dispatch the declaration in time.

Consequences of Revocation
In the event of a valid revocation, the mutually received services and any derived benefit thereof (such as interest) have to be returned. If you are unable to return the received service and benefits (for instance benefits from use) either in part or in full, or only in deteriorated condition, you may be obliged to pay compensation for lost value. This can have the consequence that you have to fulfill your contractual obligations for the period up to the time of your revocation. Obligations to refund payments have to be fulfilled within 30 days. The term begins for you upon the sending of your declaration of revocation and for us upon its receipt.
Your right of revocation expires prematurely if both parties perform their contractual duties upon your express wish before you have exercised your right of revocation.

6. No Right of Revocation for Business Customers
In the event you are acting as a business customer, which means you enter into the relevant contract in the exercise of your business or your self-employed professional activity (section 14 of the German Civil Code, BGB), you have no right of revocation.
Phonedeck shall only be liable for willful intent or gross negligence. Phonedeck shall not be liable for slight negligence, if no essential contractual obligation is violated, as far as no guarantee has been agreed upon for the quality of a service or product, as far as there is no maliciously concealed defect, default or impossibility for which Phonedeck is responsible. In case of slightly negligent violation of essential contractual duties, the fulfillment of which is required for the due execution of a contract and the observance of you rely on and may rely on, the claim for damages shall be limited to the amount of typically predictable damage. The above limitations of liability do not apply to claims for damages that result from injury to life, body or health. The liability according to the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.
As far as Phonedeck's liability is excluded or limited, the same applies for the personal liability of Phonedeck's officers, employees, representatives and agents.
Liability for subsequent damage, for instance loss of earnings and similar indirect damage and compensation for useless expenditures is excluded.
Under the current state of technology, due to maintenance work or interference with communication networks of third parties, data transfer via open networks such as the internet cannot be completely guaranteed to be available any time and error-free. Therefore, Phonedeck does not ensure and is not liable for constant and uninterrupted availability, accuracy, security, performance and reliability of the Phonedeck CSI Services or the absence of technical failure or data loss. Phonedeck will not be liable for any damage or harm to your mobile telephone, mobile device or computer, for technical failure, data loss or other harm resulting from your access to Phonedeck CSI Services. Phonedeck cannot guarantee that its website is virus-free. You shall take all necessary safety measures and install the latest security updates, in order to prevent viruses.
In order to prevent any damage resulting from data loss, you shall secure your telephone data in accordance with the current state of technology.
Phonedeck may provide a link to a third party website. Phonedeck is not liable or responsible for the availability, accuracy or content on such a third party website. You assume all risk arising from your use of any such website.
Phonedeck CSI Services are protected by copyright, trademark, all associated intellectual property rights and similar rights (the "Phonedeck Rights") by the laws of the Federal Republic of Germany and foreign countries. You are obliged to recognize and comply with the Phonedeck Rights. No copyright, right of use or other property right will be transferred to you, if not these Terms and / or the information given during the purchase of the respective CSI License stipulate otherwise.
9. Data Protection
By selecting "Order Newsletter" you may expressly order Phonedeck's newsletter. You may withdraw your consent by informal declaration at any time.
10. Venue and Applicable Law
For these Terms and all legal relations between you and Phonedeck, German Law shall apply without the provisions of the German Conflict of Laws and the International Sale of Goods. If you are a consumer, the legal provisions and rights in the country of your residence remain unaffected.
Jurisdiction over any disputes arising in connection with Phonedeck shall lie with the courts in Berlin, Germany, as far as legally admissible.
11. Severability Clause
Should individual provisions of these Terms be or become void, the validity of the remaining provisions hereof shall in no way be affected. Phonedeck and you shall undertake to replace the invalid provision in mutual consent by a valid provision, which approximates the economic purpose of the invalid provision as closely as possible. The same shall apply if a provision is found to be incomplete.
